El presente Aviso Legal regula el acceso, navegación y uso del sitio web de PÖMPON y las responsabilidades derivadas del uso de sus contenidos. El acceso al sitio implica la aceptación de este Aviso Legal.

3. Propiedad intelectual e industrial

Todos los contenidos —incluidos la marca PÖMPON, el símbolo Ö estilizado, la identidad visual, textos, fotografías, diseños y código fuente— son titularidad de PÖMPON o de terceros que han autorizado su uso, y están protegidos por la normativa de propiedad intelectual e industrial. Queda prohibida su reproducción o explotación sin autorización expresa. La marca PÖMPON y el símbolo Ö están en proceso de registro ante OEPM y EUIPO.

4. Exclusión de responsabilidad

PÖMPON no se responsabiliza de los daños derivados de la falta de disponibilidad del sitio, errores en los contenidos o presencia de virus, sin perjuicio de las medidas técnicas adoptadas. El sitio puede contener enlaces a terceros sobre cuyos contenidos PÖMPON no asume responsabilidad.

5. Legislación aplicable y jurisdicción

Este Aviso Legal se rige por la legislación española. Para consumidores, será competente el tribunal de su domicilio; para no consumidores, los tribunales de Alicante. El consumidor puede asimismo acudir a los servicios públicos de consumo y a las Juntas Arbitrales de Consumo competentes de su lugar de residencia.

2. Qué datos tratamos y para qué

• Suscripción a las novedades de PÖMPON. Si te suscribes, tratamos tu correo electrónico, el idioma de la página y el enlace por el que llegaste (parámetros de campaña, como utm_source), para enviarte novedades de la marca. Base legal: tu consentimiento (art. 6.1.a RGPD), que puedes retirar en cualquier momento con el enlace de baja de cada correo o escribiéndonos.
• Estadísticas de visitas. Medimos de forma agregada cuántas personas visitan la página, desde qué país, con qué tipo de dispositivo y desde qué enlace llegan. Usamos Cloudflare Web Analytics, que no utiliza cookies ni almacena o lee nada en tu dispositivo y no te identifica ni te sigue entre visitas o sitios. Base legal: nuestro interés legítimo en conocer el alcance de la página (art. 6.1.f RGPD); puedes oponerte escribiéndonos.
• Funcionamiento y seguridad del sitio. El proveedor de alojamiento registra de forma técnica la dirección IP de quien accede, con fines de seguridad. Base legal: interés legítimo (art. 6.1.f RGPD).

• GitHub (alojamiento de la página) — transferencia a EE. UU. amparada en el EU-US Data Privacy Framework.

No cedemos tus datos a terceros, salvo obligación legal.

5. Tus derechos

2. Purpose

This Legal Notice governs access to, browsing and use of the PÖMPON website and the responsibilities arising from the use of its content. Accessing the site implies acceptance of this Legal Notice.

3. Intellectual and industrial property

All content —including the PÖMPON trademark, the stylised Ö symbol, the visual identity, texts, photographs, designs and source code— belongs to PÖMPON or to third parties who have authorised its use, and is protected by intellectual and industrial property law. Reproduction or exploitation without express authorisation is prohibited. The PÖMPON trademark and the Ö symbol are in the process of registration with the OEPM and the EUIPO.

4. Disclaimer

PÖMPON is not liable for damages arising from the unavailability of the site, errors in its content or the presence of viruses, notwithstanding the technical measures adopted. The site may contain links to third parties for whose content PÖMPON accepts no responsibility.

5. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law. For consumers, the courts of their place of residence shall have jurisdiction; for non-consumers, the courts of Alicante. Consumers may also turn to the public consumer services and the competent Consumer Arbitration Boards of their place of residence.

2. What data we process and why

• PÖMPON news subscription. If you subscribe, we process your email address, the page language and the link you arrived from (campaign parameters such as utm_source) to send you brand news. Legal basis: your consent (Art. 6.1.a GDPR), which you can withdraw at any time through the unsubscribe link in every email or by writing to us.
• Visit statistics. We measure, in aggregate, how many people visit the page, from which country, on what type of device and from which link. We use Cloudflare Web Analytics, which does not use cookies or store or read anything on your device, and does not identify you or track you across visits or sites. Legal basis: our legitimate interest in knowing the page's reach (Art. 6.1.f GDPR); you may object by writing to us.
• Site operation and security. The hosting provider technically logs the IP address of visitors for security purposes. Legal basis: legitimate interest (Art. 6.1.f GDPR).
